Terms of service

The agreement between you and Callmate when you use our AI phone agents, outbound calling and related services.

Last updated

These terms apply to everyone who creates a Callmate account or uses the service. By signing up, you agree to them on behalf of yourself and, if you sign up for a company, on behalf of that company.

Your account

You are responsible for the activity in your account and for keeping your credentials safe. Owners and admins decide who has access and what they can do. Tell us right away at security@callmate.test if you think your account has been compromised.

Using Callmate

You may only connect phone numbers you own or are authorized to use. You agree not to use Callmate to:

  • Place calls without a lawful basis, outside permitted calling hours or to numbers on a do not call list.
  • Record calls without the notice or consent required where you or the caller are located.
  • Impersonate another person or business, or mislead callers about who they are speaking to when they ask.
  • Collect payment card data outside the secure keypad entry Callmate provides.
  • Resell the service without a written agreement with us.

Your responsibilities for calls

You decide what Callmate says, which calls it places and how recordings are handled. You are responsible for your scripts, routing rules and campaigns complying with the laws that apply to your business, including telemarketing, consumer protection and privacy laws.

Emergencies

Callmate is not an emergency service. It can route urgent calls to your team, but it does not replace 911 or other emergency numbers, and you must not rely on it as the only way callers reach help.

Plans and billing

Paid plans are billed monthly or yearly in advance. Included minutes reset each billing period and do not roll over. Extra minutes are billed in arrears at your plan's rate. You can upgrade at any time and the difference is prorated. Downgrades and cancellations take effect at the end of the current period. Prices may change with at least 30 days notice.

Service availability

We work hard to keep Callmate answering. Business plans include a 99.9% monthly uptime commitment and Enterprise plans 99.99%, with service credits if we fall short. If Callmate is unreachable, forwarded calls fall back to the number you choose. Scheduled maintenance is announced at least 72 hours in advance.

Your data

You own your data, including recordings, transcripts and the knowledge you give Callmate. We process it only to provide the service, as described in our privacy policy and data processing agreement. You can export it at any time.

Termination

You can close your account at any time. We may suspend accounts that break these terms, place unlawful calls or put other customers at risk, and will give notice where we can.

Liability

To the extent the law allows, our total liability under these terms is limited to the fees you paid in the 12 months before the claim. We are not liable for lost profits or indirect damages.

Changes

We will tell account owners by email at least 30 days before material changes take effect. Questions about these terms can go to legal@callmate.test.
